  Wow I believed in Kirk Orseck when I met him and discussed my Foreclosure / Breach of Fiduciary Duty case. My mortgage broker SFR Funding who I hired to refi my construction loan, purchased the loan hence creating the breach of fiduciary duty. He stated "I love these kind of cases" and than introduced me to his dad Gerald who on the spot quoted Meinhard vs Salmon fiduciary duty case law. Gerald stated "based on the fact we can settle the case for half. How fast can you get the money to settle?" I eagerly handed him a $2000 retainer and a few weeks later before getting to work on this case, i offered him another case which he never replied to. at that point and after communication came to a stand still, sending 10 unanswered emails to include the following " good morning kirk, i have another case with catskill hudson bank that i would like you to look at. can you call me when you get a chance. thank you ettore" and a few weeks later "hi kirk email communication is form of communication and you should answer. below is one where i ask you to take another case and it went unanswered. there are 10 more of these unanswered emails." Needless to say, he never answered the motion. Without opposition, the judge struck out my affirmative defenses and ruled against me. I have hired another attorney and he is preparing a motion to renew and re argue the case.
